A lot of people are worried about losing their house to Medicaid. That is really what we call Medicaid Estate Recovery. The Federal Government requires each state to try to get back benefits that have been paid out from the estate of a deceased individual who was getting Medicaid. In the state of Florida, the home, your homestead, is protected. So what that means for Medicaid purposes is that when you die, if your home is devised, if it’s given away to what we call Constitutional Airs, then that house will pass free of creditors. And Medicaid is nothing more than another creditor. So if, the house is passed correctly, Medicaid nor any other creditor can make that house be sold in order to pay them back.
